Does Filing For Bankruptcy Help Me In Any Way with Student Loans?

 

In most cases…no. But there are rare cases where we put the student loans in a 100% repayment plan in a Chapter 13. But that only works if the amount is affordable and the debtor does not have a large amount of other unsecured debts like credit  cards and medical bills. Once we put the student loans in a Chapter 13 repayment plan, we are obligated under the Bankruptcy Laws to put 100% of all other unsecured debts in that plan as well. So in many cases, it does not pay to do this type of Chapter 13. In rare cases, it does.
