Yes, that is correct. But don’t let that scare you. Our politicians on both sides of the isle voted to pass these laws in 2005. As part of the new law, the credit card industry demanded that counseling be done before someone files to “give them time to think about it”. This is just a stall tactic again used by the credit card industry who lobbied hard for these new laws. It is a simple process to complete and very inexpensive and you can do the counseling on line or by phone from the comforts of your home. Most of these companies are open 7 days a week and 24 hours a day to accommodate work schedules.  There is no pass/fail and our 85 year old clients do their counseling effortlessly. So don’t let that scare you. We always tell our clients that it is just a small toll to pay to get to the other side of the bridge to bankruptcy.
