Can the Court deny my Bankruptcy?
Not if you are in the proper bankruptcy that fits with your income, assets and needs, and not if you cooperate with the court. Rarely are cases denied. Some cases may be converted from a 7 to a 13 or vice versa.
For example, if a debtor files a 13 to save their home due to mortgage arrears, then decides to surrender the home and wipe out the mortgage debt, that case may qualify to convert to a Chapter 7. We do not place clients in a bankruptcy that is not right for them, nor do we accept cases that would not qualify.
